Registration of the object in the cadastre and land register

Property registration is the process of recording a property in the cadastre and land registry. Every owner of a constructed property has a legal obligation to record the property in the cadastre and land registry, as well as any changes to the property (extension, demolition, etc.).

It is important to record properties for resolving property-legal relations, buying or selling real estate, legalizing or dividing a property into condominiums, and taking out a mortgage.

In order for a facility to be registered in the cadastre and land register, a geodetic expert must prepare a geodetic study to record data on buildings.

For the purposes of implementing the building registration procedure, the subject plot with the associated building is first recorded, and then the data is computer-processed in CAD programs. The prepared study is submitted for review to the cadastre, which verifies the geodetic study and makes changes to the cadastral plan and register, or records the newly created situation.

The registration forms record changes to the subject plots in the land registry department of the Municipal Court, and the status in the cadastre is harmonized with the status in the land registers. The ownership status does not change with the geodetic study of the object’s registration.

A copy of the cadastral plan, an extract from the land register (ownership certificate), a title deed and proof of the legality of the building are required for the creation of a geodetic study for recording data on buildings. The object can be registered even without a certificate of legality. In that case, it will be entered, but with a note in the land register that no legality act was attached.

How much does a property registration study cost?

The geodetic study of object registration is a document that is prepared for the purposes of implementing changes in the cadastre and land registers in order to record the object located on the ground.

The price is defined depending on the location, plot size, size and layout of the building, compliance with the cadastre and land registry, etc.

When planning to seek the services of a surveyor, the basic information you need to prepare is the cadastral plot number and the name of the cadastral municipality and the address of the property. Based on the information about the plot and the purpose of the study, which in this case is the recording of the property, the surveyor will be able to tell you what the price of the service will be.

What documents are required for the preparation of the geodetic study of the registration of the object?

For the purposes of preparing the geodetic study, the party submits the title deed and the title deed extract or an extract from the land database (BZP). If there is an object on the plot, it is necessary to submit documentation about the construction of the object (building and use permit, decision on the completed condition, certificate of age before February 15, 1968, etc.).

Is my facility legal?

A building is legal if it has appropriate construction documentation and the condition on the ground is in accordance with the documentation. Documentation used to prove legality may be: a use permit, a certificate from the administrative body that the final report of the supervising engineer has been delivered to it, a certificate of use, a valid building permit or other appropriate document issued before 19 June 1991 with a certificate from the building inspection that no construction inspection procedure is in progress, a decision on the completed condition, a certificate of the completed condition, a certificate from the cadastral office that the building was built before 15 February 1968. and occupancy permit for buildings constructed before February 15, 1968.
If a property is registered in the cadastre and land registry, this does not mean that it is legal.

I legalized the property, is it registered in the cadastre and land registry?

If you have legalized a property, this does not necessarily mean that the property is registered in the cadastre and land registers. A surveyor can check the registration for you.

Can I list a house without permission?

Yes. Buildings without the appropriate permit can be registered in the cadastre and land registry. For such buildings, a note will be made in the land registry stating that they do not have a legality act. The note can be deleted when the appropriate permit is obtained for the building and submitted to the competent land registry court.
