Harmonization of the cadastre and land registry

Harmonization of the cadastre and land registry is a procedure by which data from the cadastre and land registry are harmonized. In the Republic of Croatia, there are still cadastral municipalities in which cadastral and land registry data differ.

The discrepancy is a legacy from the past when people avoided paying taxes by buying and selling land and did not make changes in the land registry.

In this way, it happens that purchase and sale contracts actually exist, but are never implemented.

Often, purchase and sale contracts are lost or only copies remain, the signatures on them are not certified by a notary public and as such cannot constitute the basis for entry in the title deed.

You need to find the person who sold you the plot and renew the purchase contract with them and have it certified.

However, the person who is registered as the owner of your plot is probably very old, if not dead. There are frequent situations where you can’t find the person at all because all traces of them have been lost, and that’s when problems arise. You are the user and have a purchase contract, but you can’t register in the title deed, nor can you reconcile the plots.

And although no one disputes your ownership, who will buy a property from you today if they are not sure they will be able to register it in the title deed?

Request a title deed from the cadastre and an ownership deed from the land registry and compare the areas of your plots.

They should be identical, if they are not – the problem is a mismatch.

IMPORTANT: THE CADASTRE DOES NOT INDICATE OWNERSHIP, BUT ONLY POSSESSION. THE DATA IN THE LAND REGISTER IS VALID IN OWNERSHIP.

If according to the cadastral register you own 550m2, and the land registry records 250m2, you really have 250m2 and you can dispose of that area. In case you sell it or build on it, you must first reconcile it.

If the house was built without a building permit, it is necessary to hire a designer who will carry out the legalization process and after the contributions have been paid, the process of registering the house can continue.
